Terms and Conditions

Article 1 – Definitions

* **Company**: Refers to Judith Westerveld Coaching, registered and operating in Sweden.

* **Client**: Any person or entity who enters into an agreement with the Company.

* **Consumer**: A Client who is an individual acting for personal purposes.

* **Parties**: The Company and the Client collectively.

* **Services**: Includes one-on-one coaching, group programs, online courses, community memberships, and retreats.

Article 2 – Applicability

These Terms and Conditions apply to all offers, quotations, agreements, services, and products provided by the Company.

Any deviation from these Terms is valid only if agreed in writing.

The applicability of Client’s own terms is expressly excluded.

Article 3 – Services

1:1 Coaching

* Sessions are held online via video call (e.g., Zoom, Kajabi).

* Duration: 75–90 minutes.

* Scheduling: Clients book their sessions through the scheduling system. Custom arrangements may be agreed upon directly with the Company.

* **Cancellations**: Sessions can be rescheduled up to 24 hours in advance free of charge. Sessions cancelled within 24 hours are forfeited without refund or replacement.

* **Recordings**: Recordings are available upon request and provided only to the Client.

* **Between-session support**: Clients may contact the Company between sessions via email or private voice notes. The Company will respond within 1–2 business days.

Group Programs

* Conducted online through Kajabi/Zoom or similar platforms.

* Sessions are recorded and made available to participants.

* Non-attendance does not entitle the Client to refunds.

* Refunds are not available unless expressly stated otherwise.

* Participants have access to the online learning environment and community platform.

Retreats

* Retreats are live, in-person events held in Sweden or other European locations.

* A non-refundable deposit is required to secure participation.

* The remaining balance must be paid no later than [X weeks] before the start of the retreat.

* Cancellation policy: Partial refunds may be granted only under specific conditions (e.g., documented medical reasons).

* Included/Not included: Details regarding accommodation, meals, and travel will be provided in retreat-specific materials. 

Article 4 – Prices and Payments

* All prices are listed in EUR (or the specified currency), inclusive of applicable VAT where required, unless otherwise stated.

* Payments are processed via Stripe/Kajabi or other designated platforms.

* The Company may request an upfront payment or deposit (up to 50%).

* Invoices can be issued upon request, subject to VAT and invoicing regulations depending on Client’s location.

* Payment deadlines are strict. Late payments may result in suspension of services and incur interest and collection costs.

Article 5 – Intellectual Property

* All content, materials, exercises, videos, and recordings provided by the Company remain the intellectual property of the Company.

* Clients are granted a personal, non-transferable license to use materials solely for their own purposes.

* Sharing, distributing, or reusing materials for commercial or non-commercial purposes without prior written consent is strictly prohibited.

Article 6 – No Guarantees

* The Company provides services on a best-effort basis.

* Coaching, group programs, and retreats are process-oriented and do not include guarantees of specific results, outcomes, or healing.

Article 7 – Client Responsibilities

* The Client is responsible for providing accurate information necessary for the provision of services.

* The Client agrees to actively participate and to respect the community guidelines where applicable.

Article 8 – Cancellations, Rescheduling & Refunds 

* 1:1 coaching: rescheduling allowed up to 24 hours before.

* Group programs: non-refundable and non-transferable once started.

* Retreats: deposits are non-refundable. Further cancellation terms depend on retreat-specific policies.

 Article 9 – Liability 

* The Company is only liable for direct damages caused by intent or gross negligence.

* Liability is limited to the amount paid for the specific service in question.

* The Company is not liable for indirect damages (e.g., lost profits, consequential damages).

* Participation in retreats, including travel and physical activities, is at the Client’s own risk. Clients are advised to have appropriate insurance.

Article 10 – Force Majeure

The Company is not liable for any failure to perform due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, strikes, power failures, or governmental restrictions.

Article 11 – Complaints

* Clients must notify the Company in writing of any complaints as soon as possible, with a detailed description.

* Complaints will be handled promptly and in good faith.

 Article 12 – Privacy & Data Protection

* The Company collects and processes personal data (such as name, contact information, and payment details) in accordance with the EU General Data Protection Regulation (GDPR) and, where applicable, other international privacy laws.

* Personal data will only be used for service delivery, communication, and legal obligations.

* Session recordings are confidential and will not be shared with third parties without the Client’s consent.

Article 13 – Confidentiality

* The Company commits to keeping all personal information and session content strictly confidential.

* Exceptions apply if disclosure is required by law or necessary to prevent imminent harm to the Client or others.

 Article 14 – Health & Wellbeing Disclaimer 

* Coaching services, programs, and retreats are not a substitute for medical, psychological, or therapeutic treatment.

* Clients remain solely responsible for their physical and mental health and for seeking professional help when needed.

* The Company does not diagnose, treat, or cure medical conditions.

Article 15 – Travel & Insurance (Retreats)

* Clients are responsible for arranging their own travel, accommodation (if not included), visas, and travel/health insurance.

* The Company is not responsible for travel delays, cancellations, or issues outside the retreat program.

Article 16 – Community Guidelines

* Clients participating in group programs or communities agree to engage respectfully and constructively.

* Harassment, hate speech, or inappropriate behavior is strictly prohibited.

* The Company reserves the right to suspend or remove a Client from a program or community without refund if guidelines are violated.

 Article 17 – Sever-ability & Entire Agreement

* If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions remain in full effect.

* These Terms constitute the entire agreement between the Parties and supersede all prior communications and agreements.

Article 18 – Dispute Resolution

* Parties shall first attempt to resolve any dispute amicably through direct communication or mediation.

* If unresolved, disputes shall be submitted to the competent courts of Sweden.

Article 19 – Amendments 

The Company may amend these Terms at any time. Clients will be notified of significant changes in advance. If a Client does not agree, they may terminate the agreement before the new Terms come into effect.

Article 20 – Governing Law and Jurisdiction

* These Terms are governed exclusively by Swedish law.

* Any disputes shall be submitted to the competent courts of Sweden.
